Please read this Vacation Rental Agreement carefully before beginning your vacation.
Any monies received by Sands of Alabama Vacation Rentals LLC for occupancy of a vacation property constitutes acceptance of the terms and conditions of this Vacation Rental Agreement in full. All policies are strictly enforced. It is the responsibility of all guests and members of their party to be familiar with all policies pertaining to the rental.
In consideration of the rent received and the mutual promises contained herein, the Owner of the Rental Property hereby leases and rents the Rental Property to the Primary Guest under the following terms and conditions. The Primary Guest agrees to abide by all rules and regulations contained herein, as well as any posted rules and regulations on the premises of the Rental Property.
I. GENERAL ITEMS AND REQUIREMENTS
Named Renter / Primary Guest
For legal and accounting purposes, the individual making the reservation must be the same person whose credit or debit card is used for payment. This individual is identified as the Primary Guest or Named Renter. All other occupants are considered invitees of the Primary Guest. All communication regarding the reservation, including cancellations and damage claims, will be conducted exclusively with the Primary Guest. The Primary Guest must occupy the property for the entire duration of the stay. Reservations made under false pretenses are subject to cancellation or eviction, with forfeiture of all funds paid.
Age Requirement
Rental properties will not be rented to anyone under the age of 25 (except for Beachview Condominium where the minimum age requirement is 19). The Primary Guest must meet the applicable minimum age requirement, check in personally, and remain in occupancy for the entire rental period. Failure to comply will result in immediate eviction without refund. Any reservation made under false pretenses will result in forfeiture of all payments and denial of check-in.
Good Neighbor Policy
All guests must comply with all rules and regulations established by the Homeowner’s Association (HOA). Complex security has the authority to remove any guest who fails to follow these rules, and no refunds will be provided for shortened stays resulting from such removals. Guests are responsible for keeping the property clean, safe, and in good condition and for refraining from actions that create unsafe or unsanitary conditions in the unit or common areas. The property may not be used for commercial purposes or any activity that violates criminal law or governmental regulations. Violation of any of these responsibilities constitutes a material breach of this Agreement and may result in immediate termination of occupancy without refund.
Maximum Occupancy
The number of occupants may not exceed the maximum posted occupancy or sleeping capacity listed for the Rental Property. Sands of Alabama Vacation Rentals LLC reserves the right to enter the property at any time to investigate disturbances, verify occupancy, check for damages, perform inventory checks, or complete storm preparations. No fraternities, school groups, civic groups, or other non-family groups are allowed. No parties, events, weddings, receptions, or similar gatherings are permitted. Subletting or assignment of the Rental Property is strictly prohibited. All guests must comply with posted quiet hours where applicable. Any violation constitutes a material breach and will result in immediate termination of occupancy without refund.
No Permanent Residence
Use of the Rental Property is strictly temporary and transient. Guests may not establish residency or use the property as a permanent residence.
Check-In / Check-Out
Check-in begins at 4:00 PM, and check-out must be completed by 10:00 AM. While guests may arrive any time after 4:00 PM, readiness at exactly 4:00 PM is not guaranteed. Early check-in or late check-out may be available upon request and subject to availability; additional fees may apply. Failure to vacate by the required check-out time authorizes Sands of Alabama Vacation Rentals LLC to charge a late departure fee of up to one night’s rental rate and to remove occupants and personal property from the Rental Property.
What We Supply
The Rental Property is fully furnished and includes linens, bedspreads, blankets, pillows, towels, and an equipped kitchen. Properties are re-provisioned annually; however, no guarantee is made that all items will remain throughout the rental period.
One starter supply set is provided, including:
- One roll of toilet paper per bathroom
- One face soap bar and one body soap bar per bathroom
- One roll of paper towels
- One travel-size dish soap
- One trash bag per trash can
- One single-load dishwasher detergent
- One single-load laundry detergent
Guests should plan to bring or purchase additional supplies as needed.
What You Should Bring
Personal toiletry items, hair dryers, beach towels, food, trash bags, spices, coffee, and any additional consumables or incidental supplies.
II. PAYMENTS / REFUNDS / CANCELLATION POLICIES
Cancellation Policy
Guests who cancel at least 30 days prior to check-in will receive a full refund of all amounts paid, excluding the non-refundable Management Fee. Cancellations made fewer than 30 days prior to check-in are not eligible for a refund. The Management Fee is retained to cover processing costs associated with payment collection and refund transactions. Reservations made through online travel agencies (OTAs) may be subject to different cancellation policies, which will take precedence.
Reservation Payments
For reservations made more than 30 days prior to arrival, a 25% deposit is due at booking. The remaining balance is due 30 days prior to arrival and will be automatically charged to the credit card on file. If payment fails or is not received by the due date, the reservation will be cancelled and all deposits forfeited. Final payment must be made prior to check-in. Charges will appear on statements as Sands of Alabama Vacation Rentals LLC.
Refund Policy
No refunds will be issued for inoperable appliances, unavailable amenities, maintenance visits, power outages, water shortages, flooding, inclement weather, nearby construction, early departures, or voluntary evacuations. In the event of a mandatory evacuation ordered by local authorities, unused rental nights will be refunded. The Management Fee is non-refundable. Guests are encouraged to purchase travel insurance.
Travel Insurance
Guests are strongly encouraged to purchase travel insurance. Insurance may be obtained through any provider or through Rental Guardian at

Credit Card Authorization
I understand and consent to the use of the credit card provided without original signature on the charge slip. I understand that by “clicking” that I have read the terms and conditions of this Rental Property. I am bound by this agreement, and I have signed “electronically.”
III. RULES
No Pets
Pets are strictly prohibited. Any evidence of a pet during the stay will result in immediate eviction without refund. If evidence is discovered after checkout, a $500 fine will be charged. Any HOA fines will be charged to the Primary Guest.
No Smoking
All properties are smoke-free, including e-cigarettes, except in designated outdoor areas. Violations will result in eviction without refund and a $500 non-refundable cleaning fee.
Parking
The Homeowner’s Association (HOA) determines the number of parking passes allotted and the parking pass fees for each property. Most premises are limited to two cars unless otherwise stated. Some Rental Properties have a one car limit. Some Rental Properties require Guests to purchase parking pass at the Rental Property’s lobby/security desk or online prior to arrival. Prices of parking passes are subject to change. Parking pass limits allocated for rental properties are subject to change. No guarantees are made that the purchase of a parking pass will guarantee available parking, especially during holidays and peak season. No refunds will be provided if parking pass limits are lowered for causes such as holidays, construction projects, etc. Parking passes must be always displayed in your vehicle. Property HOAs have the right to tow or boot any vehicle failing to display an authorized parking pass at the Primary Guest’s expense.
Property For Sale
If the Rental Property you are renting is listed for sale, the Owner reserves the right to schedule showings or inspections during your stay. A rental agent will make every effort to contact you in advance to arrange a convenient time and to minimize any disruption to your vacation.
Ejection / Removal
This is a vacation rental agreement subject to the provisions of section 54-22 of the Code of Ordinances of the Cities of Orange Beach & Gulf Shores. Primary Guest expressly acknowledges and accepts the right of the owner or owner’s authorized agent to remove or cause the removal of Primary Guest and guest’s invitees and permittees from the premises for any of the reasons enumerated, and in the manner provided in section 54-22; 1.) illegally possesses or deals in controlled substances, or who is intoxicated, profane, lewd or brawling; 2.) who indulges in any language or conduct which disturbs the peace and comfort of other guests or which injures the reputation, dignity, or standing of the Premises; 3.) who fails to make payment of rent at the agreed-upon rental rate by the agreed-upon checkout time; 4.) who fails to check out by the time agreed upon in writing by the Guest at check-in unless an extension of time is agreed to by the Owner or the Owner’s agent prior to checkout; 5.) who, in the opinion of the Owner, is a person the continued entertainment of whom would be detrimental to the Premises. This is not an exhaustive list of behaviors that may cause ejection or removal of guests. Guest(s) who are ejected or removed agree that any monies paid to Owner or its Agent and any monies still owing to Owner or its agent are forfeit and deemed “used” in consideration for the time it would take to rebook Guest’s unit and/or the time and effort expended in removing or ejecting Guest.
IV. MISCELLANEOUS ITEMS TO NOTE
Pool / Patio Use
Guest hereby acknowledges that the premises they have reserved may include a pool and the undersigned agrees and acknowledges that the pool and patio/deck can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Guest accepts and assumes all risks involved to Guest and all of Guest’s guests in or related to the use of the community pool and patio areas.
Lost and Found
Items left behind are not guaranteed to be recovered. Return shipping costs are the guest’s responsibility.
Maintenance and Property Conditions
The Rental Property is provided as is, and Sands of Alabama Vacation Rentals LLC is not responsible for the inoperability or unavailability of any amenities. Primary Guests must promptly contact Sands of Alabama Vacation Rentals LLC, using the contact information provided in their confirmation email, to report any maintenance or housekeeping issues, potentially hazardous conditions, or incidents related to such conditions. Guests agree to allow Sands of Alabama Vacation Rentals LLC a reasonable amount of time to respond and to cooperate with all efforts to address or resolve the concern. Reasonable steps will be taken to remedy any reported issue as quickly as possible. With reasonable notice and at reasonable times, Sands of Alabama Vacation Rentals LLC or its representatives may enter the property to inspect, maintain, or repair the unit, or to address any emergency situation that threatens persons or property. For properties with shared amenities (such as pools, hot tubs, parking areas, or fitness centers), guests acknowledge that the condition and availability of these facilities are beyond Sands of Alabama Vacation Rentals LLC’s control. Guests are responsible for any damages, losses, or excessive cleaning caused by themselves or their invitees during the stay. Sands of Alabama Vacation Rentals LLC reserves the right to charge the guest’s credit card for such costs, including cleaning, repairs, service calls, fines, or replacements, plus applicable taxes. The Owner is not required to use the least expensive method of repair or restoration. Guests should inspect the property upon arrival and report any pre-existing damage immediately to avoid potential liability. Any damages or maintenance issues that occur during the stay must also be reported promptly. While every effort will be made to correct mechanical or other failures, no refunds or rate adjustments will be issued for such occurrences. Maintenance personnel or vendors may access the property to complete previously reported repairs. The Homeowners’ Association (HOA) for the property’s complex also retains the right to enter the unit without prior guest approval. If such entry is required, Sands of Alabama Vacation Rentals LLC will make every effort to notify the guest in advance, though notice may not always be possible. HOA entry may be necessary for scheduled inspections, maintenance, or other required building services. Guests may not deny access to the HOA under any circumstances.
Property Availability
In the event Owner is unable to make Rental Property available for any reason or a reasonable substitute as determined by Owner, Primary Guest agrees that Owner’s sole liability as a result of this unavailability is to provide a full refund of all monies paid under this Agreement and Guest expressly acknowledges that in no event shall Owner be held liable for any special or consequential damages which result from this unavailability.
Entry by Owner or Agent
Owner or agent may enter the property for emergencies, disturbances, repairs, inspections, or showings with reasonable notice when possible.
Errors
Descriptions, rates, and furnishings are subject to change without notice.
Agency Disclosure
Sands of Alabama Vacation Rentals LLC acts solely as agent and representative of property owners on its rental program and is acting always in and for the best interest of the owners.
Hurricane / Named Storm Policy
Mandatory evacuations result in pro-rated refunds for unused nights. In the event of a voluntary evacuation order, guests are strongly encouraged to leave; however, no refunds will be provided Guests who choose to remain do so at their own risk and agree to hold Sands of Alabama Vacation Rentals LLC harmless for any loss or damage to personal property, as well as for any bodily injury or death that may occur. If a hurricane directly impacts the area and renders properties uninhabitable or causes citywide closures, Sands of Alabama Vacation Rentals LLC reserves the right to take up to 30 days to process full refunds for affected reservations. During this time, communication via phone, text, or email may be delayed due to potential power, internet, or cellular outages, as well as personal impacts to local staff and employees.
Security and Safety
Guests assume responsibility for personal safety and belongings. Sands of Alabama Vacation Rentals LLC is not liable for any lost or stolen items and assumes no responsibility for injuries resulting from a guest’s failure to exercise reasonable caution.
Construction
Construction or property improvements may occur at or near the property or complex during your stay. While guests may book at a time when no construction is taking place, projects may begin prior to arrival without prior notice. Some construction is managed by the Homeowners’ Association (HOA), while other work may be initiated by individual property owners and is outside of our management’s control. If we are informed of any scheduled construction, we will make every effort to notify you as soon as possible so you are aware before your arrival. However, no refunds or rate adjustments will be issued for disturbances or inconveniences caused by construction or other circumstances beyond our control. The HOA may also require guests to sign a Liability Waiver if construction is taking place at the property during your stay.
Indemnification and Hold Harmless
While Sands of Alabama Vacation Rentals LLC and its property owners strive to maintain vacation properties in the finest condition, no guarantees are expressed nor implied regarding suitability or for any particular purpose. All guest(s) and their invitees use the vacation property structures and premises at their own risk. Sands of Alabama Vacation Rentals LLC and its property owners shall not be held liable or otherwise responsible in any way for injury to any guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said guest(s) and/or invitees, or by the failure of structures, appliances, (including hot tubs and bbqs) furnishings, and/or other equipment, whether by malfunction, misuse, acts of god/nature, and/or are otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the vacation properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the vacation property and/or its contents. Sands of Alabama Vacation Rentals LLC and its property owners shall not be held liable nor otherwise responsible in any way for allergic reactions to guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the vacation property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this agreement, guest(s) and invitees hereby agree to forever hold-harmless and indemnify Sands of Alabama Vacation Rentals LLC and its property owners from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the guest(s) use of the property.
Governing Law
The undersigned Guest, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Owner from any and all liabilities, claims, demands, and causes of action by reason of any injury, loss of damage by whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result, or in connection with the occupancy of the premises and agrees to hold Owner free and harmless of any claim or suit arising there from. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover any reasonable attorney’s fees and costs. You also agree to be responsible for and reimburse the property Owner for any applicable costs and attorney’s fees incurred for collection of damage. Neither Sands of Alabama Vacation Rentals LLC nor the Owner will be responsible for accidents or injury to guest or loss of money or valuables of any kind. Owner reserves the right to terminate this Agreement upon their discretion at any time.
Agreement shall be enforced under the laws of the State of Alabama, including any applicable rental acts of that state, and represents the entire Agreement. Any amendments must be in writing and signed by both parties. In the event of a dispute, legal action may only be instituted in Baldwin County, Alabama. If any part of this Agreement shall be deemed unenforceable by law, that part shall be omitted from this Agreement without affecting the remaining Agreement. Owner shall conduct all brokerage activities in regard to this Agreement without respect to the race, color, religion, sex, national origin, handicap, or familial status of any Guest.
